Retiree Wins Lawsuit Against Ex-Wife for 40-Year Deception

Buenos Aires, November 30 (NA) -- A case that seems straight out of a streaming series has reached its judicial conclusion in Bahía Blanca: a nearly 80-year-old retiree won a lawsuit for damage to his dignity against his ex-wife, who had hidden for over 40 years that two of their three children were not biologically his.

According to the Argentine News Agency, the local Civil and Commercial Chamber upheld the first-instance ruling that condemns the woman to pay 20 million pesos plus interest (calculated from 2019) for the moral damage caused.

Four decades of deception and the cost of love The man, identified as R.G., discovered the infidelity and false paternity in early 2018, after being tormented by rumors and confirmations from an old friend. The 2019 DNA test result was conclusive: he was the biological father of only his first child.

The emotional cost of the deception was twofold, as even after their separation, the man had to face a lawsuit for alimony initiated by one of his non-biological daughters, which forced him to pay 25% of his earnings for 17 years.

A legal precedent for dignity The case set a legal precedent by invalidating a prior agreement signed by R.G. in a notary's office, whereby he had waived his right to sue his ex-wife.

The judge argued that the waiver was made "prior to the damage" (since the man signed before having the DNA confirmation) and that agreements between parties cannot nullify laws that protect essential rights, such as human dignity.
